This End-User License Agreement ("EULA" or "Agreement") is a legal agreement between you (either an individual user or a single legal entity) and the FixingBook Project Team ("Licensor", "we", "us", or "our") governing the download, copy, execution, local deployment, and modification of technical troubleshooting scripts, code snippets, database commands, and batch procedures (collectively, the "Licensed Scripts") hosted in the FixingBook registry.
1. License Grant
Subject to your strict compliance with the terms of this Agreement, Licensor hereby grants you a personal, worldwide, non-exclusive, non-transferable, non-sublicensable, revocable, royalty-free license to:
- Copy, edit, execute, and run the Licensed Scripts on local devices, servers, or systems under your direct ownership or administrative authorization.
- Utilize the Licensed Scripts for troubleshooting, diagnostics, hardware repair, configuration audits, and restoring system integrity.
2. License Restrictions
Except as explicitly authorized in Section 1, you shall not, and shall not permit others to:
- Sublicense, lease, sell, rent, or commercially exploit the Licensed Scripts, or include them within proprietary commercial repair toolkits without appropriate CC-BY-SA attribution to the original author.
- Modify, re-engineer, or adapt the Licensed Scripts for malicious intents, including the creation of ransomware, spyware, security bypasses, malware, or operations meant to disable systems without system owner consent.
- Run the Licensed Scripts on production networks or systems where you have not verified administrative rights, or where such execution conflicts with security profiles or administrative standards.
3. Disclaimer of Warranties
THE LICENSED SCRIPTS ARE COMMUNITY-SOURCED AND ARE LICENSED TO YOU "AS IS" AND "WITH ALL FAULTS." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, REGARDING THE LICENSED SCRIPTS, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, FREEDOM FROM ERROR, COMPATIBILITY WITH DRIVERS, OR RUNTIME SECURITY.
4. Mandatory User Obligations (System Backups & Audits)
Your license to utilize the Licensed Scripts is strictly conditional upon your performance of the following safeguards:
- System Backup Creation: You agree that you are fully responsible for creating and testing complete system restore images, file backups, and registry backups prior to executing any script. Licensor holds zero responsibility for data reconstruction costs.
- Audit of Rollback Paths: You must review the associated rollback guide or reversal instructions before run-time execution. If you do not understand the mechanism of a rollback path, you are prohibited from running the primary script.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR, ITS CORE DEVELOPERS, MODERATORS, OR CONTRIBUTING AUTHORS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFILE DATA, DRIVER COLLAPSES, OPERATING SYSTEM RE-INSTALLATION COSTS, BRICKED MOTHERBOARDS, VOIDED HARDWARE WARRANTIES, OR BUSINESS DOWNTIME) ARISING OUT OF THE USE OF OR INABILITY TO USE THE LICENSED SCRIPTS, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
6. Termination
This Agreement is effective from the moment you first copy, execute, or store the Licensed Scripts on your local system, and shall remain in force until terminated. This license terminates automatically and immediately without notice from the Licensor if you fail to comply with any term or condition of this EULA. Upon termination, you must delete all local copies of the Licensed Scripts in your possession and reverse any system edits performed under this license.
7. Governing Law and Severability
This EULA shall be governed by, and interpreted in accordance with, the laws of the jurisdiction of the Platform's operational base (the United States), excluding its conflicts of law rules. If any provision of this EULA is held to be invalid or unenforceable, the remaining provisions of this EULA will remain in full force and effect.
